Pitchesto // LEGAL SPECIFICATION

Terms of Service

Effective date: October 20, 2026

1. Agreement to these Terms

These Terms of Service (“Terms”) form a binding agreement between you and Pitchesto governing access to and use of the Service. By creating an account, accessing the Service, or clicking to accept, you agree to these Terms and to our Privacy Policy, Cookie Policy, and Acceptable Use Policy.

If you use the Service on behalf of an organization, you represent that you have authority to bind that organization, and “you” includes that organization.

2. Eligibility and accounts

3. Workspaces, roles, and customer data

The Service is organized around workspaces. Workspace owners control membership, billing for the platform plan, and access to prospects, projects, and settings. You are responsible for:

“Customer Content” means data, content, and materials you or your collaborators submit to the Service (including prospect profiles, research notes, drafts, proposals, and published site content).

4. The Service

Pitchesto provides software tools that may include lead discovery, deep research, website generation and editing, quality checks, sales presentation and proposal workflows, inbox/handover features, platform subscription billing, Stripe Connect-assisted client payments, and optional hosting of client sites.

Features may be limited by plan entitlements, configuration, beta flags, or regional availability. We may modify, add, or remove features with reasonable notice when practical. Beta or experimental features are provided “as is” and may change or end without liability.

5. Acceptable use

You must comply with the Acceptable Use Policy, which is incorporated into these Terms. Without limiting that policy, you may not use the Service to harass businesses, invent reviews or prices, infringe intellectual property, probe private systems, or misrepresent demos as official websites.

6. Research, discovery, and accuracy

Discovery and research features retrieve and infer information from public sources and model providers. Results can be wrong, incomplete, outdated, duplicated, or attributed to the wrong business. Rankings and recommendations are decision-support tools only.

You agree to:

7. AI-generated content

The Service uses artificial intelligence to generate text, structure, design suggestions, and analyses. AI outputs may be non-unique, may resemble third-party content, and may contain errors. You are solely responsible for reviewing, editing, and approving outputs before use in client work or publication.

You retain responsibility for ensuring generated content does not infringe rights, violate advertising law, or mislead consumers.

8. Ownership and licenses

8.1 Our IP

Pitchesto and its licensors own the Service, software, branding, documentation, and sample foundations (such as fictional demo sites). These Terms do not transfer our intellectual property to you except for the limited license below.

8.2 License to you

Subject to these Terms and your plan, we grant you a limited, non-exclusive, non-transferable license to access and use the Service for your internal business purposes of researching, pitching, delivering, and managing websites for clients.

8.3 Customer Content

As between you and Pitchesto, you own Customer Content. You grant us a worldwide license to host, process, transmit, display, and create derivative works of Customer Content solely to provide and improve the Service, prevent abuse, and comply with law.

8.4 Feedback

If you provide feedback or suggestions, we may use them without restriction or obligation to you.

9. Demos, share links, and client presentation

Private demos and share links are for authorized sales and delivery workflows. You must not present an unofficial demonstration as a business’s official live website unless that business has approved publication. You are responsible for who receives links and for rotating or revoking access when appropriate.

10. Hosting and domains

When hosting features are enabled, published sites may run on platform domains or customer domains you configure. You are responsible for DNS, domain ownership, content legality, and any third-party embeds (maps, booking, analytics) you add. We may suspend hosted content that violates these Terms or applicable law.

Export packages are provided for portability and may not be fully standalone deployable sites without additional engineering. Dynamic features may require replacement services after export.

11. Platform subscriptions and fees

Paid plans (such as Starter, Pro, and Agency) are billed through Stripe on the Pitchesto platform account. Prices are described on the Pricing page and/or in-product billing screens and may change prospectively with notice.

Failure to pay may result in suspension of paid features. Open-development or invite modes may temporarily allow use without an active paid plan; that does not waive fees when gating is enabled.

12. Client payments via Stripe Connect

Client website sales and subscriptions you charge through the Service use Stripe Connect. In the current product design:

13. Third-party services

The Service depends on third parties listed in Subprocessors (for example Firebase, Neon, Vercel, Stripe, OpenAI). Their outages, policy changes, or model behavior may affect the Service. We are not responsible for third-party sites discovered during research.

14. Confidentiality

Each party may receive non-public information from the other. The receiving party will use reasonable care to protect it and use it only to perform under these Terms, except for information that is public, independently developed, or rightfully received from another source. Customer Content is confidential to you, subject to the licenses in Section 8 and disclosures you authorize (share links, published sites, collaborators).

15. Disclaimers

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE.” TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT RESEARCH RESULTS, AI OUTPUTS, UPTIME, OR INTEGRATIONS WILL BE ACCURATE, COMPLETE, OR UNINTERRUPTED.

16. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, PITCHESTO AND ITS AFFILIATES, OFFICERS, EMPLOYEES, AND SUPPLIERS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, REVENUE, GOODWILL, DATA, OR BUSINESS OPPORTUNITIES, EVEN IF ADVISED OF THE POSSIBILITY.

OUR TOTAL LIABILITY FOR CLAIMS ARISING OUT OF OR RELATED TO THE SERVICE OR THESE TERMS WILL NOT EXCEED THE AMOUNTS YOU PAID TO PITCHESTO FOR THE SERVICE IN THE TWELVE (12) MONTHS BEFORE THE EVENT GIVING RISE TO LIABILITY (OR USD $100 IF YOU HAVE NOT PAID ANY FEES).

Some jurisdictions do not allow certain limitations; in those cases our liability is limited to the fullest extent permitted.

17. Indemnification

You will defend and indemnify Pitchesto and its affiliates against claims, damages, losses, and expenses (including reasonable attorneys’ fees) arising from: (a) Customer Content; (b) your client relationships and Connect charges; (c) your misuse of demos or misrepresentation of unofficial sites; (d) your violation of these Terms, the Acceptable Use Policy, or law; or (e) infringement claims related to materials you provide.

18. Term and termination

These Terms apply while you use the Service. You may stop using the Service and close your account as available in-product. We may suspend or terminate access for violations, risk, non-payment, or discontinuation of the Service. Upon termination, your license ends; Sections that by nature should survive (including ownership, disclaimers, liability limits, indemnity, and governing law) will survive.

19. Governing law and disputes

These Terms are governed by the laws of the United States and the State designated by counsel for the operating entity (to be completed before public launch), excluding conflict-of-law rules. Courts in that venue will have exclusive jurisdiction, except that either party may seek injunctive relief in any competent court for IP or misuse of the Service.

Optional arbitration / class-action waiver language should be added by counsel if desired for consumer or commercial posture.
